The Seven D Industries, LP Product Warranty
Warranty is a coverage against any defects in material and workmanship occurring as a direct result of the manufacturing process, as to the structural parts of the basic window unit under conditions of normal use and service, in residential application to the original property owner named in this certificate, so long as the original property owner(s) are living and own an equity interest in the property identified in this certificate. Warranty is limited to a period of ten years in any of the following applications: commercial, governmental, religious, schools, condominiums, cooperative housing buildings or buildings and apartments not used solely by the original property owner(s) who are living and own an equity interest in the property identified on this certificate. ALL OTHER APPLICATIONS SHALL HAVE NO WARRANTY. The hermetic seal is warranted against defects resulting in material obstruction of vision from film formation caused by dust or moisture condensation on the internal glass surfaces for 20 years from the date of installation (photo required). GLASS BREAKAGE IS NOT COVERED UNDER THIS WARRANTY. Should the unit fail in the first 10 years, the company will provide the replacement unit at no charge FOB Patton, PA. During year 11 thru 20 the company will provide the replacement on a pro-rated basis. Year 11, 50% of the cost of the replacement unit at the then prevailing cost. Year 12 through 20 will decline 5% per year. Replacement cost is for the glass unit only FOB Patton, PA, and does not cover any labor charges so long as the original property owner(s) are living and own an equity interest in the property identified in this certificate. This warranty is void if the unit has been cracked, broken, or subjected to excessive heat. ALL MOVING PARTS, such as balances, operators, hinges and locking mechanisms are warranted for a period of ten years against material and workmanship so long as the original property owner(s) are living and own an equity interest in the property identified in this certificate. THIS WARRANTY DOES NOT APPLY TO ANY DAMAGE CAUSED BY IMPROPER INSTALLATION, ACCIDENT, FIRE, FLOOD, EXPLOSION, OR MISUSE. WARRANTY EXCLUSIONS & LIMITATIONS: This warranty does not cover defects resulting from accidents, alterations, improper installation, failure to follow instructions, misuse (including failure to perform reasonable and necessary maintenance), abuse, settlement of the structure, failure of the structure, fire, lightning, hurricanes, tornadoes, windstorms, hail, vandalism, earthquakes or other acts of God, impact of foreign objects or other causes beyond the control of Seven D Industries, LP. Seven D Industries, LP will not be responsible for any costs or damages in respect to the removal, installation or reinstallation of any of the components or products. THIS WARRANTY DOES NOT COVER ANY COMPONENTS OR PRODUCTS INSTALLED IN SHIPS, VEHICLES OR OUTSIDE THE UNITED STATES. THIS WARRANTY DOES NOT COVER ANY UNIFORM FADING OR COLOR CHANGE DUE TO NORMAL WEATHER CONDITIONS SINCE NORMAL WEATHERING WILL CAUSE ANY COLORED SURFACE TO GRADUALLY FADE OR DARKEN. This warranty makes no representation with respect to condensation on the windows, as condensation is the natural result of moisture in the house and changes in temperature and humidity. It does not indicate a defective window. This warranty is in lieu of all other expressed guarantees. No dealer or installer is authorized to change or add to this warranty. Exclusion of implied warranty; the expressed warranties set fourth herein are the sole warranties given by the company and shall extend only to the original property owner(s) that are living in and own and equity interest in the property identified in this certificate. All implied warranties; including but not limited to any implied warranty of merchantability of fitness for a particular purpose or use, are excluded from this agreement. In no event shall the company be liable for incidental or consequential damages. The remedies provided in the expressed warranties are the sole and exclusive remedies of the original property owner(s) that are living in and own an equity interest in the property listed in this certificate. Some states do not allow the exclusion or limitation of incidental, consequential or other damages, so that the above limitations do not apply to you. To the extent permitted by law, the company’s liability for direct, incidental, consequential or other damages shall not exceed the original purchase price of the components or product. OTHER CONDITIONS: Seven D Industries reserves the right to discontinue or change any of its products without notice. In the event products covered under this warranty are no longer available, Seven D Industries reserves the right to make substitutions that in Seven D Industries opinion, are of equal price or quality. REGISTRATION OF THIS WARRANTY: The attached warranty registration card must be completed in full, by the property owner(s) and installer or dealer and mailed to Seven D Industries warranty registration within 30 days after completion of the installation. Failure to register will cause all warranties to be voided. HOW TO EXERCISE YOUR WARRANTY: To initiate a claim on this warranty you must send a detailed description of your defect claimed, a copy of proof of purchase, and a reference to this certificate number and date of installation within 30 days of defect discovery to: WARRANTY DEPARTMENT 120 Beech Ave., Patton, PA 16668. Upon receipt of your claim, Seven D Industries will, at their discretion, do one or more of the following: send a representative to make an inspection, send the warranty replacement parts to the nearest dealer in your area or send the warranted replacement parts directly to you FOB Huntingdon, PA. THIS WARRANTY SETS FORTH ALL THE RESPONSIBILITIES OF SEVEN D INDUSTRIES, LP, THIS WINDOW AND ITS COMPONENTS.
